1. Acceptance of Terms
By accessing or using this website (the "Site"), you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the Site.
2. Who We Are
Butler Legal Service, P.L.L.C. ("the Firm," "we," "us," "our") is a law practice owned and operated by Shatrasha Butler, J.D. The Firm is not a full-service law firm. We focus our practice on select areas where we offer particular expertise and advocacy, and we make no representation that we can assist with every legal matter. If your matter falls outside our areas of focus, we may decline representation or refer you elsewhere.
3. No Attorney-Client Relationship
Use of this Site, submission of a contact form, participation in an intake questionnaire, attendance at a community outreach event, or any email correspondence with the Firm does not, by itself, create an attorney-client relationship. An attorney-client relationship is formed only when:
We have confirmed we can take on your matter,
Any conflicts of interest have been cleared, and
Both you and the Firm have signed a written engagement agreement.
Until that happens, please do not send us confidential or sensitive information through the Site that you would only want shared with an attorney who represents you.
4. Licensure and Jurisdictional Limits
The attorney is licensed to practice law only in Missouri and North Carolina. Nothing on this Site is intended as legal advice regarding the law of any other state or jurisdiction, and the Firm does not intend to advise on legal matters that do not involve Missouri or North Carolina law. If you are located outside of, or your legal matter arises outside of, Missouri or North Carolina, please consult an attorney licensed in the relevant jurisdiction.
5. No Legal Advice
The content on this Site, including any blog posts, FAQs, flyers, and general educational material, is provided for general informational purposes only. It is not legal advice and should not be relied upon as such. Laws change, and the information here may not reflect the most current legal developments. Your specific situation may differ from the examples described on this Site. You should consult with a licensed attorney regarding your particular circumstances before taking or refraining from any action.
6. Specialization Disclaimer
North Carolina attorneys may not use the terms "specialist," "specialize," "certified specialist," or similar variants to describe their services except as permitted under Rule 7.4 of the North Carolina Rules of Professional Conduct. Nothing on this Site should be read to suggest that the Firm or its attorney holds a board certification or specialist designation in any area of law unless expressly and accurately stated.
7. Intake Process and Community Programs
From time to time, the Firm offers structured intake for specific service offerings (such as estate planning bundles) through community and outreach events. Completing an interest form, questionnaire, or sign-up sheet at such an event reserves your place in the intake process, it does not mean you have retained the Firm. Services begin only after the applicable minimum participation threshold (if any) is met, your questionnaire is reviewed, payment is received, and a written engagement agreement is signed.
8. Email Communications
If you email the Firm, please understand:
Email is not a fully secure method of communication. Email may be copied and stored by computers and servers it passes through enroute between sender and recipient, and it is possible for third parties to intercept email by improperly accessing a device or network involved in the transmission.
By emailing us, you consent to receiving communications from us via email. If you would prefer a different method of communication, let us know and we will accommodate that request going forward.
Do not send highly sensitive personal information (such as Social Security numbers or financial account numbers) via unencrypted email.
9. Intellectual Property
All content on this Site, including text, graphics, logos, and the "Butler Legal Service" name and branding, is the property of Butler Legal Service, P.L.L.C. unless otherwise noted, and may not be reproduced, distributed, or used without prior written permission.
10. No Warranties
This Site is provided "as is" without warranties of any kind, express or implied. The Firm does not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
11. Limitation of Liability
You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Site or Service. Additionally, the Firm is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus or line or system failure; (ii) loss of revenue, anticipated profits, business, savings, goodwill, or data; and (iii) third-party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property — regardless of our negligence, gross negligence, or failure of an essential purpose, and whether such liability arises in negligence, contract, tort, or any other theory of legal liability. The foregoing applies even if the Firm has been advised of the possibility of, or could have foreseen, the damages. In states that do not allow the exclusion or limitation of liability for certain damages, our liability is limited to the fullest extent permitted by law. In no event shall the Firm's cumulative liability to you exceed the total purchase price of the Service you have purchased from the Firm, and if no purchase has been made by you, the Firm's cumulative liability to you shall not exceed $100.
This limitation of liability applies to your use of the Site and to general, non-legal aspects of any Service. It does not apply to, and does not limit or waive, the Firm's professional responsibilities or liability in connection with the actual practice of law or legal services rendered under a signed engagement agreement, which are governed separately by that agreement and by the applicable Rules of Professional Conduct.
12. Indemnification
You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third-party claims and causes of action, including, without limitation, attorneys' fees, arising out of any breach by you of these Terms of Use, or any use by you of the Site or Service. You shall provide us with such assistance, without charge, as we may reasonably request in connection with any such defense, including providing information, documents, records, and reasonable access to you as we deem necessary. You shall not settle any third-party claim or waive any defense without our prior written consent.
13. Our Intellectual Property
The Site and Service contain intellectual property owned by the Firm, including, without limitation, the Firm's logo, all designs, text, graphics, and other files, and the selection and arrangement thereof (also termed the "look and feel"), trademarks, trade dress, copyrights, proprietary information, and other intellectual property. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce, or perform, or in any way exploit in any format whatsoever, any of the Site or Service content, in whole or in part, without our prior written consent. We reserve the right to immediately remove you from the Service, without refund, if you are found to be in violation of this intellectual property policy.
14. Links to Third-Party Sites
This Site may contain links to third-party websites. The Firm does not control and is not responsible for the content, privacy practices, or accuracy of any linked third-party site.
15. Changes to These Terms
We may update these Terms of Use from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
16. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, unless otherwise required by applicable rules of professional conduct.
